1. Objective and responsible authority

  1. This Privacy Policy clarifies the nature, scope and purpose of collecting, processing (hereinafter referred to as ‘processing’) and using data within our services and the connected websites, functions and contents (hereinafter referred to as ‘service’ or ‘website’), independent of the domains, systems, platforms and devices (e.g. desktops or portable devices) used to operate our Service.
  2. Service provider and the authority responsible for data processing is TP Automation e.K. Automatisierungs- und Elektroprodukte, Kreuzgraben 36, 91462 Dachsbach, Germany, http://www.tpautomation.de/Imprint:_:4.html (hereinafter referred to as ‘we’ or ‘us’).
  3. The term "User" means all customers and visitors of our online offer. The terms used here, e.g. "User", are gender neutral.

2. Essential information for data processing and security

  1. We will process personally identifiable data within the scope of the law and not without your required further consent only to the extent necessary for the conclusion and execution of our contractual relationship.
  2. We take organizational, contractual and technical security measures to ensure that the provisions of data privacy laws are complied with and, as a result, the data managed by us is protected from accidental or intentional manipulations, loss, destruction or access by unauthorized persons. These security measures are monitored on a regular basis and updated according to industry standard as necessary.
  3. If, within the framework of this Data Privacy Statement, contents, tools or other means and mediums are used by other providers (hereinafter referred to collectively as "Third-party Providers") and whose registered office is abroad, it is assumed that a data transfer to the countries where those registered offices of the Third-party Providers are located takes place. The transmission of data to third-party countries is either based on legal authorization, user consent or specific clauses in the contract, which provide for legally required data security.

3. Processing of personal data

  1. Personal data, in addition to the use expressly named in this agreement and allowed by law, is used for the following purposes:
    • The provision, maintenance, security and execution of our services
    • Ensuring effective customer services and technical support.
  2. We pass your data on to third parties where this is necessary for invoicing purposes (e.g. carrying out transactions) or for other reasons to enable us to fulfil our contractual obligations to you. Should such passing on not be clear to you, we will point it out to you.
  3. The following mandatory information is collected within the user registration process:
    • Forename and surname
    • Email address
    • Postal address or other shipment information
  4. Beyond the aforementioned information, each user decides themselves whether to provide further information.
  5. We use the personal information submitted in the course of the order process (e.g. name, e-mail address, address, payment information) to process and complete the order. This data is treated as confidential and is not shared with third parties who are not involved in the order, delivery and payment processes.
  6. Upon contacting us, information is saved for the purpose of processing the request and for the event that follow-up questions arise.

4. Server Log-Files

  1. During every visit of our websites information about IP address, referring URL, date/time, browser version and operating system, amount and state of transferred data is stored in the web server log files.
  2. We use the log data without any other personal or pseudonymous profiling as required by law. We only use it for the purpose of the operation, security and optimization of our service. However, we reserve the right to subsequently review the protocols in all instances in which, based on specific indications, there is justified suspicion of illegal use.

5. Newsletter

  1. With the following information, we will clarify the contents of our newsletter as well as registration, dispatch and statistical evaluation procedures, including your right of objection. By subscribing to our newsletter, you agree to receive the newsletter and to the procedures described here.
  2. Content of the newsletter: We send newsletters, emails and other electronic notifications with promotional materials (hereinafter referred to as "Newsletter") only with the consent of the recipient or with legal permission. If, in the context of registering for the Newsletter, the contents of the Newsletter are specifically described, then that is decisive for the consent of the Users. Furthermore, our Newsletter contains information about our products, offers and our company.
  3. Non-promotional information includes notifications that are sent within the scope of the contract or business relations. This includes, for example, the sending of service emails with technical or organizational information within the framework of our provision of services, billing information, information concerning technical and legal changes, and questions regarding orders.
  4. Double opt-in and logging: The registration for our Newsletter uses a so-called double opt-in procedure. You will receive an email after registration, in which you will be asked to confirm your registration. This confirmation is necessary so that no one can log on with another email address. The registration for the Newsletter is recorded in order to be able to prove the registration process took place in accordance with legal provisions. This includes the storage of the login and the time of confirmation, as well as the IP address.
  5. Statistical survey and analysis – the Newsletter contains a so-called "web beacon"; a pixel-sized file retrieved from our server when the Newsletter is opened. Within the framework of this fetch, technical information, such as information concerning the browser type and your system, as well as your IP address and time of retrieval, are collected. This information is used to technically improve the services on the basis of the technical data or the target groups and their reading behaviour by means of their retrieval locations (which can be determined using the IP address) or the access times. Statistical surveys also include determining whether the Newsletters are opened, when they are opened, and which links are clicked. This information can be assigned to individual Newsletter recipients for technical reasons. It is, however, not our intention to observe individual Users. The evaluations serve to help us recognize

  1. Cookies are information which is transferred from our web server or third-party web servers to the user's web browser and are saved there for further retrieval. Within the framework of this Privacy Policy, users are informed of the use of cookies within the context of pseudonymously measuring the Internet audience.
  2. Viewing this online service is also possible without using cookies. If users do not wish for cookies to be saved on their computer, they are requested to deactivate the appropriate option in their browser's system settings. Saved cookies can be deleted in the browser's system settings. The exclusion of cookies can lead to limitations in the functionality of the online service.

7. Google Analytics

  1. We use Google Analytics, a Google Inc. (‘Google’) web analysis service. Google uses cookies, text files that are saved on users' computers and allow the use of the online service to be analysed. The information generated on the user's use of the online service by the cookie is generally transferred to a Google server in the US where it is saved.
  2. Google will use this information on our behalf in order to assess users' use of the online services, in order to compile reports on the activities within this online service and in order to render addition services for us associated with the use of the online service and Internet use.
  3. We only use Google Analytics with activated IP anonymization. This means that Google shortens user IP addresses within an EU member state or in other contractual states of the Agreement on the European Economic Area. Only in exceptional cases is the full IP address transferred to a Google server in the US where it is shortened.
  4. The IP address transferred by the user's browser is not linked to other Google data. Users can prevent cookies being saved through the appropriate setting on their browser software; users can also prevent the acquisition of the data generated by the cookie and related to the use of this online service in addition to the processing of this data by Google by downloading and installing the available browser plug-in at the following link: http://tools.google.com/dlpage/gaoptout?hl=en.

8. Incorporation of third party services and content

  1. It may be that third-party content or services, such as videos from YouTube, city maps or graphics, are integrated within our online offer from other websites. The inclusion of third-party content always assumes that the Third-party Providers detect the IP address of the User because they cannot send the content to the User's browser without the IP address. The IP address is therefore required for the display of such content. Furthermore, the third-party content providers may set their own cookies and process the data of the Users for their own purposes. Usage profiles of the Users can be created from the processed data. We will use this content as sparsely as possible and in a data-avoiding manner as well as choose Third-party Providers that are reliable in regards to data security.
  2. If we integrate third-party content or services, we provide you with an overview of Third-party Providers as well as their contents, together with links to their data privacy statements, which contain further information on the processing of data and possibilities to object (so-called opt-out).

9. Service, Notices and Deletion of Data

  1. In compliance with legal requirements we will at any time provide you with information on your personally identifiable data stored by us, free of charge and without undue delay. Please refer to the contact information on our website.
  2. Furthermore, you are free to revoke the approvals granted by confirming this Privacy Policy, as well as correct, erase or block your personally identifiable data at any time and with future effect. Users have the right to submit a complaint to the competent supervisory authority in the event of the presumption of unlawful data processing.
  3. We delete the stored personal data, as soon as it is not needed for its purposes anymore and as this is in compliance with all legal storage obligations.

10. Amendments of this Privacy Policy

  1. We may change the Data Privacy Statement in order to adapt it to changed legal situations or to changes in the service and in the data processing. However, this only applies to declarations concerning data processing. If Users' consent is required or if elements of the Data Privacy Statement contain provisions concerning the contractual relationship with the Users, the changes are only made with the consent of the Users.
  2. Please check back periodically, and especially before you provide any new personally identifiable information.
